1. PARTIES
The website www.xploreracing.com (the website) is operated by X-Plore Racing, with registration number xxxx-xxxxxx, (the seller), with a registered address at Sven källfelts gata 204, 426 71 Västra Frölunda, Sweden. The seller's VAT registration number is SE XXXXXXXXX. The buyer is the person specified as the buyer on the order (the buyer). The seller provides the products (products) available on the website.
These terms of sale, along with the order and order confirmation, constitute the complete contractual basis for the purchase (the agreement).
2. PRICES
The prices listed on the website are inclusive of VAT but exclusive of shipping. Information about the total amount the buyer is required to pay, including environmental fees where applicable, and all other charges and shipping costs, as well as the itemized breakdown of the total amount, will be specified in the order before payment is made.
3. CONCLUDING THE AGREEMENT
The seller acknowledges the receipt of the order electronically. All orders must be approved by the seller. Since the receipt acknowledgment does not serve as an order confirmation, the seller provides such confirmation by sending an email to the buyer, confirming that the product has been shipped (the order confirmation). The buyer must review the order confirmation to ensure that the quantity, product type, price, etc., match the order. Any discrepancies between the order and order confirmation should be reported to the seller as soon as possible by e-mailing info@xploreracing.se.
To purchase from the website, the buyer must be over 18 years of age, have the legal capacity to enter into binding agreements, and purchase for personal use without the intention of resale. The seller reserves the right to cancel orders made by buyers with the intention of reselling the products.
4. PAYMENT
The seller accepts payment via MasterCard, Visa, and PayPal. The seller will not charge the buyer's payment or credit card until the product has been shipped. The seller may reject the buyer's order if the buyer's payment or credit card is not approved.
5. DELIVERY, ETC.
Goods will be delivered to the address specified in the order confirmation. The buyer will select the delivery method from the options available during the order. The delivery date depends on the chosen delivery method and will be specified in the order confirmation. If more than one product has been ordered, the seller reserves the right to ship the products in separate shipments.
6. OWNERSHIP OF THE PRODUCT
Ownership of the product transfers to the buyer only when the seller has received full payment for all amounts related to the product. If the delivery date has passed without the buyer ensuring the product is delivered after it becomes available, the buyer assumes responsibility for any loss or damage to the product.
7. RIGHT OF WITHDRAWAL
The buyer may cancel the purchase of the product at any time and for any reason within seven working days, starting from the day after receiving the product. The right to cancel the purchase can be exercised even if the product is in perfect condition, either before or after the product is delivered. If the product has been delivered, and the buyer wants to cancel the purchase, the buyer must return the product to the seller. The seller covers the return costs and refunds the amount the buyer paid. When the buyer returns a product to the seller due to canceling the agreement in accordance with section 7, the seller will handle the refund to the buyer as soon as possible and always within 30 days of receiving the returned product.
8. NON-CONFORMITY OF THE PRODUCT WITH THE ORDER OR DEFECTS/DAMAGE UPON DELIVERY
Upon receiving the product, the buyer should check if the product matches the order and if it has been damaged during transportation or is defective. If the product does not match the order, has been damaged during transportation, or is defective, the buyer must notify the seller in accordance with section 9. The seller will refund or replace products that are damaged, defective, or do not match the order.
9. CLAIMS REGARDING DEFECTIVE PRODUCT AFTER DELIVERY
If the buyer discovers that the product is defective after delivery, the buyer must notify the seller within a reasonable time after discovering the defect. This must be done within two months of the buyer's discovery of the defect. This should be communicated in writing by e-mailing info@xploreracing.se. If the product is defective, the buyer must return the defective product to the seller. The seller covers the return costs and refunds the amount the buyer paid or replaces the defective product.
10. DEFAULT INTEREST
If the buyer does not pay the amount due according to the agreement, the seller may charge 1.5% interest.
11. RETURN POLICY:
WE OFFER A 30-DAY OPEN RETURN
If you are not satisfied with the product, you can return it to us or exchange it for a different size within 30 days after receiving it. We will refund the full amount you paid for the item(s) you return.
HOW TO RETURN A PRODUCT:
You can return a product by e-mailing us at info@xploreracing.se between 9:30 and 18, Monday to Friday.
- We will assist you with a return number and a shipping label.
- You can then send the product back to us. This is free of charge as long as you use the shipping label provided by us.
- Keep the receipt as proof that the package has been sent.
HOW TO REQUEST AN EXCHANGE:
You can exchange a product for a different size by e-mailing us at info@xploreracing.se between 9:30 and 18, Monday to Friday.
- We will order the new item and provide you with a return number and a shipping label for the original item.
- You can then send the product back to us. This is free of charge as long as you use the shipping label provided by us.
- Keep the receipt as proof that the package has been sent.
YOU CAN RETURN/EXCHANGE ITEMS IF:
- The products are unused and unwashed (you can try them on to see if they fit, of course)
- The product is still in the undamaged original packaging (it's fine if the packaging has been opened carefully)
- All tags are attached
- The product is complete (e.g., for a pair, both parts must be returned)
- You have kept a receipt as proof that the package was sent (in case the return gets lost in the mail)
IMPORTANT: If you return products to us without contacting customer service and obtaining the return number, we may not be able to process your return shipment or guarantee a refund.
11. PERSONAL DATA - PRIVACY
The seller uses the buyer's personal data to fulfill its obligations under the agreement. The seller also uses the buyer's personal data to inform the buyer about products similar to those the buyer has purchased, unless the buyer informs the seller that they do not wish to receive such information.
If the buyer has given their consent, the seller may use the buyer's personal data to send advertising materials or information about other products that do not resemble those the buyer has purchased. Such voluntary and informed consent can be given when the agreement is concluded.
The buyer can contact the seller by e-mail at info@xploreracing if the buyer has questions about how the seller uses their personal data or wishes to withdraw their consent regarding personal data for marketing purposes, access or modify their personal data, or request its deletion.
12. DISPUTE RESOLUTION AND JURISDICTION
The parties shall attempt to resolve all disputes amicably. If the dispute cannot be resolved amicably, it shall be brought before a Swedish court.
This agreement and all disputes or claims arising in connection with the subject matter of this agreement are governed by Swedish law.
